Patna High Court

Amit Kumar Singh @ Rinku SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner, holding that the absence of specific allegations against him warranted release on bail under Section 482(2) of the BNSS.

Summary

The petitioner, Amit Kumar Singh, sought bail in a criminal case (PS Case No.598 of 2025) alleging assault and conspiracy to seize land, where the FIR named him among 40-50 accused but did not allege any specific act by him. He claimed innocence, arguing that the only specific allegations were against co-accused Pinku Singh and that he had a prior criminal case for which he was on bail. The State opposed the bail application. The Court examined whether the lack of specific allegations justified granting bail under Section 482(2) of the Bharatiya Nyaya Sanhita. Finding no direct charge against the petitioner, the Court ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions including appearance before the trial court and non‑interference with witnesses. The bail was granted subject to compliance with the stipulated conditions.
