Patna High Court

Amit Kumar @ KalluversusThe State of Bihar

DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner subject to conditions and verification of his criminal antecedent.

Summary

The petitioner, Amit Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 131 litres of liquor from a bush near a cattle shed. He argued that the liquor was not found in his possession, the location did not belong to him, and the informant (the chowkidar) failed to report his involvement earlier, casting doubt on the prosecution's case. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs. 25,000 with two sureties and directed verification of the petitioner’s criminal antecedent. If more than five prior cases are found, the bail will not be confirmed; if exactly five, it will be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in the case registered under Section 30(a) of the Bihar Excise Act.
  • Whether the alleged facts and the petitioner’s criminal antecedent justify denial of anticipatory bail.

that if Chowkidar was aware of the involvement of the
