Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedent.

Summary

Petitioner Rahul Kumar Safi was implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly recovering 36 litres of liquor from a Hyundai car. He argued that he was not apprehended on the spot, had no conscious possession of the liquor, and was not the owner of the vehicle, claiming the case was based on secret information. The petitioner also disclosed that he had four prior cases under the Excise Act. The State opposed his prayer for anticipatory bail. The High Court, considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.20,000 with two sureties and directed verification of his criminal antecedent. The order stipulated that if more than four prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under Section 482(2) of the BNSS in view of the alleged offence under Section 30(a) of the Bihar Excise Act and his prior criminal antecedent.
