The Court granted provisional anticipatory bail with conditions, pending verification of the petitioner’s criminal antecedent.
Summary
The petition filed by Jhariya Devi sought anticipatory bail after she feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, alleging recovery of 18 litres of liquor and 7 kg of Mahua flowers from a hut near a government school. The petitioner argued that she was not in possession of the contraband, the premises were public, and she was implicated mechanically by the police without proper investigation, despite having only one prior excise case. The State opposed the bail. The Court, considering these submissions, granted provisional anticipatory bail subject to a bail bond of Rs 5,000 with two sureties and compliance with Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS, and ordered verification of her criminal antecedent. If more than one prior case is found, the bail will not be confirmed; if only one, it will be confirmed. The petitioner was also directed to deposit Rs 1,500 with the Patna High Court Advocate Association.
Issues considered
- Whether anticipatory bail can be granted under Section 438 Cr.P.C. to a person accused of an offence under the Bihar Prohibition and Excise Act, 2016 when no possession is established.
- Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
