Patna High Court

Munchun RamversusThe State of Bihar

Holding

The court granted regular bail to the petitioner.

Summary

Munchun Ram was arrested on charges under Section 7 of the Prevention of Corruption Act and Section 308 of the Bihar Negotiable Securities Act for allegedly accepting a bribe of Rs.5,000 while facilitating an electricity connection. The petitioner contended that the FIR was fabricated, he had no criminal record, and a co‑accused had already been released on bail in a similar case. The State and the Special Vigilance Unit opposed bail, arguing the seriousness of the offence. After hearing both sides, the Patna High Court found no compelling reason to keep the petitioner in custody and ordered his release on regular bail. He was required to furnish a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the accused in a corruption case under Section 7 of the PC Act and Section 308 of the B.N.S.
  • Whether the alleged facts and the petitioner’s lack of antecedents justify continued judicial custody
