Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner, subject to a bail bond of Rs.10,000 and two sureties, and the conditions of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

Ram Pravesh Pandey, husband of Rani Kumari, feared arrest in a criminal case registered under several sections of the Bharatiya Nyaya Sanhita and the Dowry Prohibition Act. The parties had resolved their dispute through mediation, with a mediator’s report dated 28‑04‑2026 and a settlement attached. The petitioner’s counsel argued that the settlement negated the need for arrest, while the opposite party’s counsel did not contest this claim. The court examined whether the existence of a mediated settlement warranted the grant of anticipatory bail. Relying on the settlement and the provisions of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, the court allowed anticipatory bail subject to a bond and sureties. The order directs that if arrested within eight weeks, the petitioner be released on bail under the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite pending charges under the Bharatiya Nyaya Sanhita and Dowry Prohibition Act
  • Whether a mediation settlement can be a sufficient ground to dispense with arrest
