RAKESH SAH @ RAKESH GOND @ RAKESH KUMARversusTHE STATE OF BIHAR

Holding

The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Rakesh Sah, sought anticipatory bail in a case registered under Sections 274 and 275 of the Bihar Narcotic (BNS) Act, 2023 read with Section 30(a) of the Bihar Excise Act, alleging that the alleged seizure of 20 litres of liquor was from a public bush and not from his possession. He contended that the complaint was filed on the basis of a hostile informant and that the police had not conducted a proper investigation. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.30,000 with two sureties and that the trial court verify his criminal antecedent. The order stipulated that if the petitioner is found to have more than six prior excise cases, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the alleged offences under Sections 274 and 275 of the BNS Act and Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s prior criminal antecedent of six excise cases precludes the grant of anticipatory bail.
