Provisional anticipatory bail is granted subject to bond, sureties and verification of antecedents, with confirmation contingent on a clean record.

Summary

Sonu Kumar, a resident of Vaishali, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging the recovery of 180 litres of liquor from a motorcycle. He asserted that he had a clean antecedent, was not caught in possession of the liquor, and was not the owner of the seized vehicle, claiming he was implicated by a local person. The State opposed his request for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs. 500 with two sureties and that the trial court verify his criminal antecedents within six weeks. If any antecedent is discovered, the provisional bail will not be confirmed; otherwise, it will be confirmed forthwith. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the circumstances of non‑possession and lack of ownership justify granting anticipatory bail.
  • What conditions may be imposed on anticipatory bail pending verification of the petitioner’s antecedents.
