The Court granted provisional anticipatory bail with conditions, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Shailendra Kumar, sought anticipatory bail fearing arrest in a case under Sections 30(a) and 32(2) of the Bihar Prohibition and Excise (Amendment) Act, 2018, where 225,540 litres of liquor were allegedly recovered from a car parked outside his house. He contended that he was not the owner of the vehicle, had no conscious possession of the liquor, and that the police were targeting him based on his prior criminal antecedent. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.15,000 with two sureties and a condition that the petitioner surrender within six weeks. The court also ordered verification of the petitioner’s criminal antecedent; if more than three cases are found, the bail would not be confirmed, otherwise it would be confirmed. Additionally, the petitioner agreed to deposit Rs.2,500 with the Patna High Court Lawyers’ Association.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in an excise case where the alleged seizure was from a vehicle not owned by him and he claims lack of possession.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.

                                 2. The petitioner apprehends his arrest in a case

recovery is from a car which was parked outside his house. It is

further submitted that petitioner is not the owner of the seized

vehicle and came to be implicated based on the fact that the car

was parked near his house. It is next submitted that off late

police have started implicating accused in excise cases who

have antecedent without holding a proper investigation of the

          case.

                       5. Learned A.P.P. for the State opposes the prayer for

it is found that petitioner has antecedent of more than three

cases, it would be presumed that petitioner had concealed his

antecedent before this Court at para 3 of the anticipatory bail

application in that event the provisional anticipatory bail order

                     of the Patna High Court.
