The court granted provisional anticipatory bail, subject to verification of the petitioner’s antecedent and compliance with conditions under Section 438(2) CrPC.

Summary

Nitish Kumar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 350 litres of liquor. He argued that he has a clean antecedent, was not arrested at the spot, and that the alleged liquor was recovered from a public place, not from his possession. The petitioner also contended that the amendment to the Excise Act, 2018, abolished the concepts of deemed possession and presumed offender, and that the confessional statements of co‑accused taken in police custody lack evidentiary value. The State opposed the bail. The Patna High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties and conditions under Section 438(2) CrPC, directing the trial court to verify the petitioner’s antecedent before confirming the bail.

Issues considered

  • Whether anticipatory bail can be granted when the alleged offence under Section 30(a) of the Excise Act involves alleged recovery of liquor from a public place without possession by the accused.
  • Whether the amendment to the Excise Act, 2018, which removed the concepts of deemed possession and presumed offender, affects the grant of anticipatory bail.
  • Whether confessional statements of co‑accused made in police custody can be relied upon to deny anticipatory bail.
