Holding
The Court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his antecedent.
Summary
The petitioner, Naresh Kumar Poddar, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 40 litres of liquor from his scooty. He argued that he has a clean antecedent, was not present at the spot of seizure, and was unaware that his friend misused the vehicle. The State opposed the bail, contending possible flight risk and tampering with evidence. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his antecedent. The order further stipulated that if any prior case is discovered, the bail would be revoked, otherwise it would be confirmed.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC.
- Whether the petitioner’s ownership of the vehicle implicates him in the offence under Section 30(a) of the Excise Act.
- Whether the petitioner poses a risk of fleeing or tampering with evidence.
