Holding
The Court granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of his criminal antecedent.
Summary
The petitioner, Virendra Mahto, sought anticipatory bail fearing arrest under Section 30(a) of the Bihar Excise Act for alleged recovery of Rs. 11,960 from a paasi khana not belonging to him. He argued that he was not arrested on the spot, no contraband was found in his possession, and the case was based solely on a confessional statement made by Rahul Kumar while in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending the seriousness of the offence. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 10,000 with two sureties and conditions under Section 482(2) of the BNSS, directing the trial court to verify the petitioner’s criminal antecedent. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.
Issues considered
- Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where the only evidence is a confessional statement made in police custody.
- Whether the absence of recovery from the petitioner’s possession and the location of the alleged contraband affect the grant of anticipatory bail.
- Whether the conditions imposed under Section 482(2) of the BNSS are appropriate for provisional anticipatory bail.
