The Court allowed anticipatory bail subject to conditions and verification of antecedents.

Summary

Petitioners Sikandar Sah and Antima Devi applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in a case registered under Section 30(a) of the Excise Act for alleged recovery of 35 litres of liquor and 100 litres of mahua from a hut adjacent to their house. They argued that the recovered items were not in their conscious possession, the premises did not belong to them, and they were implicated due to a hostile chaukidar. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioners be released on provisional anticipatory bail upon furnishing bail bonds of Rs.10,000 each with two sureties, subject to verification of their criminal antecedents. The order also stipulated that if the petitioners concealed prior cases, the bail would not be confirmed, but if verification showed no concealment, the bail would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438(2) CrPC for offences punishable under Section 30(a) of the Excise Act.
  • Whether the petitioners' prior criminal antecedents affect the grant of anticipatory bail.

recovery is from a place, which does not belong to the

petitioners, but then is adjacent to their house and they came to

                                      7. The application stands allowed.

                                      8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioners shall

verify the criminal antecedent of the petitioners and in the event,

if it is found that petitioner no.1 has antecedent of more than

two cases and petitioner no.2 has antecedent of even one case,

then it would be presumed that petitioners for the purposes of

obtaining anticipatory bail had concealed their antecedent

before this Court, in that event, the present provisional

anticipatory bail order shall not be confirmed, but if on

verification, it is found that petitioner no.1 has antecedent of

more than two cases and petitioner no.2 has antecedent of even

one case, in that event, the provisional anticipatory bail order

                         shall be confirmed forthwith.

                                      9. At this stage, the learned counsel appearing on

behalf of the petitioner based on instruction submits that

petitioner undertakes to deposit an amount of Rs.2500/- with
