Raja Kumar ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to bond and surety conditions.

Summary

Petitioner Raja Kumar Chaudhary sought anticipatory bail after being implicated in a case under the Bihar Prohibition & Excise Act for alleged trafficking of 53.640 litres of Nepali liquor recovered from a motorcycle registered in his name. He contended that the motorcycle had been handed over to co‑accused Krishna Kumar and that he had no knowledge or involvement in the illegal activity. The State opposed the bail, arguing the seriousness of the offence. The Court noted that the illicit liquor was not found in the petitioner's constructive possession and, applying Section 482(2) of the B.N.S.S., 2023, decided to grant anticipatory bail. The order directed the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to appear before the Special Judge within four weeks.

Issues considered

  • Whether anticipatory bail can be granted when the alleged contraband is not in the petitioner's constructive possession.
  • Whether Section 482(2) of the B.N.S.S., 2023 permits the grant of anticipatory bail in this circumstance.

dated 16.12.2025, registered for the offences punishable under

Section 30(a), 41 of Bihar Prohibition & Excise Act.

                                3. As per the prosecution case, police had recovered

                                4. Learned counsel for the petitioner submits that the

petitioner is innocent and has been falsely implicated in the

present case. The alleged recovery has been made from the

motorcycle belonging to the petitioner; however, as a matter of

fact, the said motorcycle was given to the co-accused, namely,

may be imposed by this Court while granting the privilege of

                      anticipatory bail.

                                   5. Learned APP for the State opposes the prayer for

                      grant of anticipatory bail application.

                                   6. Regard being had to the submissions made by the

parties, and taking into consideration the fact that the illicit

liquor has not been recovered from the constructive possession

of the petitioner, this Court is inclined to grant anticipatory bail

                      to the petitioners.

                                   7. Let the petitioner, above named, be released on

anticipatory bail in the event of arrest or surrender before the

court below within a period of four weeks from today on
