The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedents.

Summary

Gautam Mahto applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act, alleging recovery of 125 litres of liquor from a public place. He contended that no liquor was found in his possession, the alleged recovery site did not belong to him, and the informant’s identity was omitted from the FIR, raising doubts about the prosecution’s case. The State opposed the bail, citing his antecedent of five prior cases, two of which were under the Excise Act. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.25,000 with two sureties, subject to verification of his criminal antecedents. The order stipulated that if verification reveals more than five prior cases, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for an offence punishable under Section 30(a) of the Excise Act.
  • Whether the petitioner’s criminal antecedent of five cases, including two under the Excise Act, precludes the grant of anticipatory bail.
  • Whether the absence of recovery from the petitioner’s possession and the non‑disclosure of the informant in the FIR affect the merit of the bail application.
