The Court granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedent and compliance with the conditions under Section 482(2) of the BNSS.
Summary
Mantosh Paswan applied for anticipatory bail after the police registered a case against him under Sections 30(a) and 30(c) of the Bihar Excise Act for alleged recovery of 170 litres of liquor and 1,000 litres of raw Jawa Mahua from a public area. The petitioner claimed he was not caught in possession and that the recovered material did not belong to him, arguing that the investigation was mechanically based on a chowkidar's complaint. The State opposed the bail. The High Court, considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs. 35,000 with two sureties and that the trial court verify his criminal antecedent. If the verification shows more than seven prior cases, the bail will not be confirmed; if it shows exactly seven, the provisional bail will be confirmed. The order was made under Section 482(2) of the BNSS.
Issues considered
- Whether anticipatory bail can be granted in a case under the Bihar Excise Act, Sections 30(a) and 30(c).
- Whether the petitioner’s criminal antecedent of seven cases affects the grant of anticipatory bail.
- Whether the trial court must verify the antecedent before confirming the provisional bail.
