Patna High Court

Amit Paswan @ Amit KumarversusThe State of Bihar

Decided

DISPOSED

Holding

The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Amit Paswan, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 17 litres of liquor from a location not under his control. He argued that he was not in possession of the liquor and that the police had mechanically implicated him without proper investigation, despite having three prior excise cases. The State opposed his application for anticipatory bail. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.15,000 with two sureties and that the trial court verify his criminal antecedent. If the verification shows more than three prior cases, the bail will not be confirmed; if only three, the bail will be confirmed. The order was made under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bihar Negotiable Securities Act.

Issues considered

  • What is the appropriate exercise of discretion by the Court in granting anticipatory bail under Section 438 Cr.P.C. in a case involving alleged excise offences?
  • Whether the petitioner’s prior three excise cases preclude the grant of anticipatory bail.
