Patna High Court

Satyendra Singh @ Satendra Kumar SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Summary

The petitioner, Satyendra Singh, was implicated in an FIR alleging that he assaulted the informant's father with a knife, invoking sections of the Bharatiya Nyaya Sanhita. He applied for anticipatory bail, asserting innocence, a clean antecedent, and that the altercation arose during a land measurement dispute resulting in minor injuries on both sides. The State opposed the bail application. The court examined the nature of the accusations, the extent of injury, and the petitioner's clean record. Considering these factors, the court granted anticipatory bail, directing the petitioner to surrender within eight weeks and furnish a bail bond with sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The order was pronounced by Justice Prabhat Kumar Singh of the Patna High Court.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita given the nature of the alleged offences and the petitioner's clean antecedent.
