Anticipatory bail is granted to the petitioner subject to a bail bond and conditions under Section 482(2) of the B.N.S.S., 2023.
Summary
The petitioners, Pankaj Kumar (alias Pankaj Rai), sought anticipatory bail fearing arrest in a case (Kathaiya P.S. Case No. 91 of 2026) involving alleged possession of illicit foreign liquor under the Bihar Prohibition & Excise Act. The prosecution alleged that a large quantity of liquor was recovered from a tank near the petitioner’s poultry farm, and that the petitioner and another individual were identified as owners. The petitioners contended that they were falsely implicated based on secret information, had no connection to the seized liquor or the location, and that the identification was merely the result of villagers’ statements. The State opposed the anticipatory bail. The Court, after hearing counsel, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the B.N.S.S., 2023.
Issues considered
- Whether anticipatory bail should be granted to the petitioner in the alleged offence under the Bihar Prohibition & Excise Act
- Whether the petitioner’s alleged connection to the seized liquor is sufficient to deny bail
