Patna High Court

Ranjeet RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on the condition of a Rs 5,000 bond with two sureties.

Summary

The petitioner, Ranjeet Ram, was arrested in connection with the alleged recovery of 705.9 litres of liquor from his orchard and 207 litres from a motorcycle parked at a third‑party’s premises, and is charged under Sections 112(2) and 3(5) of the BNS and Section 30(a) of the Bihar Excise Act. He has three prior cases under the Excise Act and has been in custody since 18‑02‑2026. The petitioner contended that he was not arrested at the spot, no liquor was found in his conscious possession, and he has no ownership or relationship with the premises or the seized vehicle. The State opposed bail, citing the seriousness of the offences and the petitioner’s criminal antecedents. The Court, after considering the submissions and the period of custody, ordered the petitioner’s release on bail upon furnishing a bond of Rs 5,000 with two sureties of the same amount, pending trial.

Issues considered

  • Whether bail should be granted to the petitioner despite prior excise cases and the nature of the alleged offences under the BNS and Bihar Excise Act.
