The Court allowed the anticipatory bail application, granting provisional bail subject to verification of the petitioner’s antecedent.
Summary
Anand Kumar applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 720 litres of liquor. The petitioner argued that he has a clean antecedent, was not arrested, no liquor was found in his possession, and the FIR does not even name him, suggesting a weak prosecution case. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs 500 with two sureties, subject to verification of his antecedent by the trial court. The order stipulated that if any prior case is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was allowed.
Issues considered
- Whether anticipatory bail under Section 438 CrPC should be granted to the petitioner in a case under Section 30(a) of the Excise Act, given the lack of arrest, absence of possession, clean antecedent, and omission of the petitioner’s name in the FIR
