The Court granted provisional anticipatory bail subject to bail bond, sureties, and verification of the petitioner’s criminal antecedent.
Summary
Satish Yadav sought anticipatory bail fearing arrest in a case registered under Sections 317(4) and 111(4) of the Bihar Narcotic Substances Act, 2023, read with Section 30(a) of the Bihar Excise Act. He contended that he was not caught in the act, no liquor was recovered from his possession, and he was implicated solely on secret information, despite having three prior cases, one of which involved alleged recovery of 750 litres of liquor. The State opposed the bail. The Court, after hearing both sides, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.15,000 with two sureties and that the trial court verify his criminal antecedents. If the verification shows more than three prior cases, the bail will not be confirmed; if only three cases are found, the provisional order will be confirmed. The order was made under Section 482(2) of the Bihar Narcotic Substances Act.
Issues considered
- Whether anticipatory bail can be granted in a case involving alleged excise offences and narcotic provisions.
- Whether the reliance on secret information without seizure from the accused’s possession justifies denial of bail.
- Whether the petitioner’s criminal antecedent of three cases affects the confirmation of anticipatory bail.
