The court granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedents and compliance with the stipulated conditions.
Summary
The petitioner, Lalbabu Yadav, sought anticipatory bail after learning that he might be arrested in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 342 litres of liquor from seized vehicles. He argued that he was not caught in possession, was not the owner of the vehicles, and was implicated solely on secret information without a proper investigation. The State opposed the bail application. The High Court, considering these submissions, granted provisional anticipatory bail conditioned on the petitioner furnishing a bail bond of Rs.15,000 with two sureties and subject to verification of his criminal antecedents. The court stipulated that if the petitioner is found to have more than three prior cases, the bail would not be confirmed; if he has exactly three, the provisional bail would be confirmed.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Excise Act given the circumstances of his alleged involvement and prior criminal antecedents.
