The Court allowed the anticipatory bail application, granting provisional bail subject to conditions.

Summary

Karmi Devi applied for anticipatory bail anticipating arrest in a case under Section 30(a) of the Excise Act for alleged recovery of 40 litres of liquor from a cycle. She argued that she was not in possession of the liquor, was not the owner of the cycle, and was implicated due to a personal dispute involving a chaukidar. The State opposed the bail, citing her antecedent of three prior Excise cases. The Court considered the submissions and directed that she be released on provisional anticipatory bail upon furnishing a bail bond of Rs.15,000 with two sureties, subject to Section 438(2) of the Cr.P.C. The trial court was instructed to verify her criminal antecedent and, if more than three cases are found, to revoke the bail; otherwise, the bail would be confirmed. Consequently, the application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in a case under Section 30(a) of the Excise Act.
  • Whether the petitioner’s antecedent of three prior Excise cases disqualifies her from obtaining anticipatory bail.
  • Whether lack of possession and ownership of the seized cycle impacts the grant of bail.
