Holding

The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s antecedent.

Summary

Chandrika Paswan applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a FIR alleging offences under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Excise Act. The petitioner claimed that the alleged recovery of 20 litres of liquor was from a premises adjacent to his house and that he was not arrested at the spot, arguing that the complaint was motivated by an inimical watchman. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to verification of his criminal antecedent. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; if only two are found, the bail would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted in a case involving alleged offences under Sections 274 and 275 of the Bihar Narcotic Substances Act and Section 30(a) of the Excise Act.
  • Whether the petitioner’s prior criminal antecedent of two excise cases precludes the grant of anticipatory bail.
  • Whether the absence of arrest and the alleged recovery of liquor from a premises adjacent to the petitioner’s house affect the bail decision.

implicated at the instance of Chaukidar with whom he is on an

inimical term. It is further submitted that if Chaukidar was

then why he did not inform the police prior to institution of the

                       5. Learned A.P.P. opposes the anticipatory bail

          application.
