The Court granted provisional anticipatory bail subject to bond, sureties and verification of antecedent.
Summary
Baiju Manjhi applied for anticipatory bail under Section 438 of the Cr.P.C. in connection with a case under Section 30(a) of the Excise Act alleging recovery of 320 litres of liquor from an e‑rickshaw. The petitioner argued that he was not arrested at the spot, had no conscious possession of the liquor, was not the owner of the e‑rickshaw, and was implicated solely on confessional statements of co‑accused made in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing a bail bond of Rs.20,000 with two sureties, subject to verification of his criminal antecedent. The order stipulated that if the petitioner is found to have more than four prior cases, the bail would be revoked; otherwise, it would be confirmed. The application for anticipatory bail was allowed.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. in view of the alleged offence under Section 30(a) Excise Act and his criminal antecedent.
