Provisional anticipatory bail is granted subject to verification of the petitioner’s antecedent and compliance with the stipulated conditions.
Summary
Petitioner Kamlesh Mallik sought anticipatory bail after an FIR was lodged under Section 30(a) of the Bihar Excise Act alleging recovery of 15 litres of liquor near his house and 10.5 litres from a motorcycle. He contended he had a clean antecedent, was not in possession of the liquor, did not own the vehicle, and was implicated due to an enmity with the chowkidar who lodged the complaint. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.500 with two sureties and directed the trial court to verify the petitioner’s antecedent. If any prior case is found, the bail will not be confirmed; if the petitioner is found to have a clean record, the provisional bail will be confirmed. The order was made under Section 482(2) of the BNSS.
Issues considered
- Whether anticipatory bail should be granted to the petitioner in a case under Section 30(a) of the Bihar Excise Act.
- Whether the petitioner’s alleged lack of possession and clean antecedent justify anticipatory bail.
