Mohan Manjhi @ Sohan ManjhiversusThe State of Bihar

Holding

Provisional anticipatory bail is granted subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

Mohan Manjhi sought anticipatory bail after being implicated in a case under Section 30(a) of the Bihar Excise Act for alleged recovery of 120 litres of liquor from a bamboo orchard that did not belong to him. The petitioner argued that he was not apprehended on the spot, no liquor was found in his possession, and the police had mechanically implicated him without proper investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs.5,000 with two sureties and directed verification of the petitioner’s criminal antecedent. It warned that if more than one prior case is found, the bail would not be confirmed; if only one prior case is found, the bail would be confirmed. The order was made under Section 482(2) of the Code of Criminal Procedure.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the alleged facts and lack of possession justify granting bail.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
