Holding
The court granted bail to the petitioner, directing his release upon surrender with a bond and sureties, as the incident was a free fight and injuries were simple.
Summary
The petitioner, Anil Yadav, was named in an FIR for assaulting an informant and others with an iron rod and a khanti, allegedly causing head and bodily injuries. He contended that the incident was a "free fight" arising from a land dispute, with both sides sustaining injuries, and argued that the injuries were simple in nature, warranting anticipatory bail. The State opposed the bail, citing the seriousness of the charges under multiple sections of the Bhartiya Nyaya Sanhita, 2023, and the petitioner’s involvement in other criminal cases. Relying on the Supreme Court precedent in State of Himachal Pradesh v. Shamsher Singh, the court examined factors such as the nature of the injury, weapon used, and conduct before and after the incident. Finding that the assault was part of a mutual fight and the injuries were not grievous, the court ordered that the petitioner be released on bail upon surrender, subject to a bond of Rs.10,000 with two sureties and conditions under Section 438(2) of the CrPC and Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC/Section 482 BNSS given the nature of the alleged assault and injuries.
- Whether the facts constitute a case under Section 109(1) of the Bhartiya Nyaya Sanhita, 2023 justifying denial of bail.

5. It is submitted by learned counsel appearing for
petitioner that the present occurrence was free fight in

set of occurrence, the petitioner’s side also lodged his case
at first instance, which was registered as Cherki P.S. Case
No.88 of 2025, countering the aforesaid case, the present
case was lodged. It is submitted that merely on the ground
that the assault as alleged to be caused by this petitioner
was made on head of injured, the prayer of anticipatory bail
of petitioner was rejected though, the nature of injury upon

that merely as alleged assault was caused on head, the

considered to make out a case under Section 109(1) of the
BNS like, nature of injuries, nature of weapons, the manner
of assault and the conduct of accused pre and post
