Holding

The Court granted provisional anticipatory bail to the petitioners, subject to verification of their antecedents and compliance with the stipulated conditions.

Summary

The petitioners, Rakesh Singh and Nilesh Kumar Singh, applied for anticipatory bail in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 410.040 litres of liquor from a public place near a dam. They argued they have clean antecedents, were not arrested at the spot, and the liquor was not found in their possession, contending that the accusation stemmed from local informants whose identity was omitted from the FIR. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail for six weeks, subject to a bail bond of Rs. 500 with two sureties and verification of the petitioners' criminal antecedents by the trial court. The order stipulated that if any antecedent is discovered, the bail would be withdrawn for that petitioner; otherwise, the provisional bail would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 30(a) of the Bihar Excise Act.
  • Whether the absence of arrest and lack of possession of the liquor justify granting bail.
  • Whether concealment of any criminal antecedent by the petitioners affects the grant of anticipatory bail.
