Patna High Court

Umesh Ray @ Lakadi Rai @ Umesh RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is to be granted to the petitioner as the prosecution failed to establish possession and a proper investigation.

Summary

The petitioner, Umesh Ray, was charged under Section 30(a) of the Bihar Excise Act for alleged recovery of 315 litres of liquor from a location behind Rita Devi's house and 19.5 litres from a motorcycle. The petitioner argued that he was not arrested at the scene, had no conscious possession of the liquor, and was not the owner of the seized vehicle, claiming he was implicated by a hostile chowkidar. He further contended that the police had mechanically implicated him without proper investigation. The State opposed bail, but the court considered the lack of direct possession and the questionable investigation. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 5,000 with two sureties. The bail order was directed to be complied with by the trial court handling the case.
