The Court granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent, with confirmation contingent on the antecedent being limited to two prior cases.
Summary
Amar Kumar petitioned for anticipatory bail after a case was registered against him under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018/2022 for alleged recovery of 53.040 litres of liquor from a hut near his son Rohit Kumar's house. The petitioner argued that the liquor was not in his possession, the alleged recovery occurred on premises not owned by him, and the primary evidence was a confessional statement of Rohit Kumar made while in police custody, which he claimed lacked evidentiary value. He also highlighted that he had only two prior cases under the Excise Act. The State opposed the anticipatory bail. The Court, applying Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S., granted provisional anticipatory bail subject to a Rs.10,000 bond and two sureties, with a condition that the trial court verify his criminal antecedent; if more than two prior cases are found, the bail will not be confirmed, otherwise it will be confirmed immediately.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 of the Cr.P.C.
- Whether the confessional statement of Rohit Kumar made in police custody can be relied upon as evidence.
- Whether the petitioner’s prior criminal antecedent exceeds two cases, affecting the confirmation of anticipatory bail.
