Patna High Court

Motilal Manjhi @ Motilal MajhiversusThe State of Bihar

Decided

DISPOSED

Holding

The Court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his criminal antecedent.

Summary

The petitioner, Motilal Manjhi, sought anticipatory bail after a complaint under Section 30(a) of the Bihar Excise Act alleged that six litres of liquor were recovered from his joint family house. He argued that he had no prior criminal record, the liquor was not found in his conscious possession, and the concept of deemed possession had been abolished by the 2018 amendment to the Excise Act. The State opposed the bail, contending that the petitioner could be implicated based on the guard's testimony. The Court noted that the petitioner could be released provisionally on bail bonds and sureties, subject to verification of his antecedents by the trial court. It further stipulated that if any prior conviction is discovered, the provisional bail would not be confirmed; otherwise, it would be confirmed. The order was made under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 30(a) of the Bihar Excise Act.
  • Whether the amendment removing the concept of deemed possession affects the bail application.
  • Whether the joint family nature of the property precludes attribution of possession to the petitioner.
