Patna High Court

Prakash Kumar @ Prakash DasversusThe State of Bihar

DISPOSED

Holding

The Court provisionally granted anticipatory bail to the petitioner, subject to bail bond conditions and verification of his criminal antecedent.

Summary

The petitioner, Prakash Kumar, sought anticipatory bail after fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 106.570 litres of liquor from a Toto vehicle. He argued that he was not in possession of the liquor, did not own the vehicle, and was implicated solely on a confessional statement made by Manoj in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending that the petitioner had prior excise cases. The Court granted provisional anticipatory bail, requiring a bail bond of Rs.10,000 with two sureties, subject to verification of the petitioner’s criminal antecedent within six weeks. The order stipulated that if more than two prior cases are found, the bail would be cancelled; if exactly two are found, the bail would be confirmed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 482(2) of the BNSS in a case under the Bihar Excise Act.
  • Whether the confessional statement of a co-accused made in police custody can be the sole basis for implicating the petitioner.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.

                             2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                             3. Learned counsel for the petitioner submits that the

petitioner has antecedent of two cases under the Excise Act and

petitioner was not arrested from the spot as such nothing was

recovered from his conscious possession and is not the owner of

an accused is implicated in a case relating to excise, the police

starts implicating mechanically either at the instance of

Chowkidar, local person, confessional statement or secret

counsel for the petitioner, the petitioner above-named, in the event

of his arrest or surrender before the learned trial court within a

period of six weeks from today, be released on Provisional

anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees

                   7. It is made clear that thereafter the learned Trial Court

shall verify the criminal antecedent of the petitioner and in the

event if it is found that petitioner has antecedent of more than two

cases then it would be presumed that petitioner, for the purposes of
