Nitish KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to anticipatory bail subject to the conditions imposed under Section 482(2) of the B.N.S.S.

Summary

The petitioner, Nitish Kumar, sought anticipatory bail in connection with FIR No. 100 of 2025 alleging offences under several sections of the B.N.S., 2023, including assault and outraging modesty. The prosecution alleged that during a land dispute the petitioner and others assaulted the informant's family and stole cash. The petitioner contended innocence, asserting a case‑and‑counter‑case scenario with mutual injuries and no direct allegation of assault against him, and highlighted that five co‑accused had already been granted anticipatory bail. The State and the informant opposed the bail, emphasizing the specific charge of outraging modesty. The Court, noting the reciprocal claims, lack of overt act against the petitioner, and the precedent of bail to co‑accused, granted anticipatory bail subject to a Rs.10,000 bond, sureties, and strict conditions under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite allegations of assault and outraging modesty.
  • Whether the existence of a case‑and‑counter‑case and prior bail to co‑accused justify granting anticipatory bail.
  • Whether Section 482(2) of the B.N.S.S. permits the Court to impose conditions on anticipatory bail.
