The Court ordered provisional anticipatory bail for the petitioner, subject to conditions and verification of antecedents, under Section 482(2) of the BNSS.

Summary

The petitioner, Deepak Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning the alleged recovery of 87.480 liters of liquor from under a bridge. He argued that the liquor was not in his possession, the location did not belong to him, and the complaint was instigated by a village watchman without prior police notification. The State opposed the bail. The Court, considering the petitioner's clean antecedent and the circumstances, granted provisional anticipatory bail subject to a Rs. 500 bond, two sureties, and verification of his criminal record by the trial court. If any antecedent is found, the bail will not be confirmed; otherwise, it will be confirmed forthwith. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in a case under Section 30(a) of the Bihar Excise Act

                   learned A.P.P. for the State.

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner is a person with clean antecedent and allegation is of

recovery of 87.480 liters of liquor from a place under a bridge.

                                4. Learned counsel for the petitioner submits that

petitioner was not apprehended from the spot as such nothing

was recovered from his conscious possession and even alleged

recovery is from a place which does not belong to the petitioner

and is accessible to villagers at large and he came to be

inimical term. It is also submitted that if Chowkidar was aware

of the involvement of the petitioner in the occurrence then why

he did not inform the police prior to institution of the instant

counsel for the petitioner, the petitioner above-named, in the

                       7. It is made clear that thereafter the learned Trial Court

shall verify the criminal antecedent of the petitioner and in the

then it would be presumed that petitioner, for the purposes of

seeking anticipatory bail, had concealed his antecedent before this
