The court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his antecedent.
Summary
The petitioner, Bullet Yadav, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, where 115.72 litres of liquor were allegedly recovered from five motorcycles, one of which he owned. He argued that he had a clean antecedent, was not present at the spot of seizure, and was unaware that his friend misused his vehicle. The State opposed the bail. The court considered the submissions and directed that the petitioner be released on provisional anticipatory bail, subject to furnishing bail bonds of Rs.500 with two sureties and verification of his antecedent by the trial court. The order stipulated that if any antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed. The application for anticipatory bail was allowed.
Issues considered
- Whether the petitioner is entitled to anticipatory bail under Section 438 CrPC in a case under Section 30(a) of the Excise Act.
- Whether the petitioner’s ownership of the vehicle and alleged lack of knowledge of the offence justify granting bail.
