Holding

The court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s antecedent.

Summary

Shankar Mahto sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act read with Sections 111, 125(a), 125(b) and 281 of the Bihar Narcotic Substances Act, 2023, alleging recovery of 954 litres of liquor from a Scorpio vehicle. He argued that he was not caught in possession, was not the vehicle's owner, and the only link to him was a confessional statement made by another accused, Tapendra, while in police custody, which he claimed lacked evidentiary value. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.20,000 with two sureties and that the trial court verify his criminal antecedent within six weeks. If more than four prior cases are found, the bail will not be confirmed; if only four, the provisional bail will be confirmed. The order was made under Section 482(2) of the Bihar Narcotic Substances Act.

                                2. The petitioner apprehends his arrest in a case

                                4. Learned counsel for the petitioner submits that

petitioner was not apprehended from the spot as such nothing

was recovered from his conscious possession and is not the

does not have any evidentiary value. It is also submitted that of

late, police has started implicating accused with criminal

          without holding a proper investigation.

                       5. Learned A.P.P. for the State opposes the prayer for

                       7. It is made clear that thereafter the learned Trial

Court shall verify the criminal antecedent of the petitioner and
