Holding

The court granted anticipatory bail to petitioners 1, 3 and 4 and dismissed the application of petitioner 2 as withdrawn.

Summary

The petitioners, four Yadav brothers, feared arrest in a criminal case registered under several sections of the Bharatiya Nyaya Sanhita and the Arms Act, alleging false implication arising from a land dispute. They filed an anticipatory bail application, but later withdrew the application for petitioner No. 2, Kamlesh Yadav. The court considered the petitioners' claim of clean antecedents (for petitioner No. 1) and minor prior cases (for petitioners No. 3 and 4), and noted that the allegations were general and omnibus. The State opposed the bail. The court granted anticipatory bail to petitioners No. 1, 3 and 4, subject to a bail bond of Rs 10,000 with two sureties each, and dismissed the application of petitioner No. 2 as withdrawn.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the listed sections of the Bharatiya Nyaya Sanhita and the Arms Act
