The Court granted regular bail to the petitioner.

Summary

The petitioner, Yogi Kumar, was arrested in connection with a case (PS No. 981 of 2025) alleging possession of a country‑made pistol and live cartridge, and charged under Sections 310(4) and 310(5) of the Bharatiya Nyaya Sanhita and Sections 25(1‑B)(a), 26 and 35 of the Arms Act. He contended that he was falsely implicated, had no prior criminal record, and that the charge‑sheet had already been filed. The State opposed his bail, citing the seriousness of the offences. The Court noted that co‑accused persons in similar circumstances had already been granted regular bail, the petitioner had been in custody since 12‑09‑2025, and there was no likelihood of evidence tampering or absconding. Accordingly, the Court ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under Sections 310(4), 310(5) of the Bharatiya Nyaya Sanhita and Arms Act provisions.
  • Whether the nature of the offences and the risk of tampering with evidence or absconding justify denial of bail.
