The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s criminal antecedent.
Summary
Petitioner Pradip Mishra sought anticipatory bail fearing arrest under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022. He has two prior cases, one involving alleged recovery of 777.600 litres of liquor from two Scorpio vehicles, but was not arrested on the spot and no liquor was found in his possession. The petitioner argued that he is not the owner of the seized vehicles and that the only link to him is a confessional statement of another accused made in police custody, which lacks evidentiary value. The State opposed the bail. The Court granted provisional anticipatory bail on a bond of Rs.10,000 with two sureties, subject to verification of the petitioner’s criminal antecedent; if more than two prior cases are found, the bail will not be confirmed, otherwise it will be confirmed.
Issues considered
- Whether anticipatory bail can be granted in a case under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether a confessional statement of a co‑accused made in police custody can be relied upon to deny bail.
- Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
