The court granted bail to the petitioner, subject to verification of ownership of the seized motorcycles and compliance with bail conditions.
Summary
The petitioner was named in an FIR for alleged theft of three motorcycles, two of which were claimed to belong to his family members and were recovered from his premises. The petitioner argued that the police raid was irregular, noting that the seizure list was prepared three days after the raid at the police station, casting doubt on the recovery. He also asserted a clean antecedent and that he could not immediately produce ownership documents. The Additional Public Prosecutor opposed bail, but the court, considering the procedural irregularities and the petitioner's background, ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS. The trial court was directed to verify the ownership of the two motorcycles before accepting the bail bond.
Issues considered
- Whether the petitioner is entitled to bail despite the FIR charges under the Bhartiya Nyaya Sanhita.
- Whether procedural irregularities in the seizure of the motorcycles justify granting bail.
