Holding
The petitioner is entitled to bail as the allegations against him are unsubstantiated and the matter is compromised.
Summary
Prem Kumar was implicated in a missing‑girls case after one of the girls, a minor, was found at his house. The FIR, filed under Sections 137(2) and 140(3) of the Bhartiya Nyaya Sanhita, alleged kidnapping and sexual assault, but no specific allegation was made against Prem Kumar. The girl’s statement under Section 183 of the BNSS indicated she had gone to his house voluntarily, and there was no evidence of any physical relationship or assault. A compromise between the parties was filed in the District Court, and the petitioner asserted a clean antecedent. The court observed that the allegations against the petitioner were not substantiated and, considering the compromise and his clean record, ordered his release on bail subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS.
Issues considered
- Whether the petitioner can be granted bail under Section 438 CrPC and Section 482(2) BNSS when the FIR does not specifically allege his involvement in kidnapping or sexual assault.
- Whether the compromise filed between the parties is sufficient ground to justify bail.
