DISPOSED

Holding

The Court allowed the anticipatory bail application, granting provisional bail subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Rohit Kumar, applied for anticipatory bail anticipating arrest in a case under Section 30(a) of the Excise Act concerning the alleged recovery of 82.4 litres of liquor. He argued that he was not arrested at the spot, had no possession of the seized motorcycles, was not named in the FIR, and was implicated by local villagers. The State opposed the bail, citing his criminal antecedent of four cases, including one under the Excise Act. The Court granted provisional anticipatory bail on condition that the petitioner furnish bail bonds of Rs.20,000 with two sureties and appear before the trial court within six weeks. The order also directed verification of his antecedent, stating that if more than four cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for offences under Section 30(a) of the Excise Act when the accused is not named in the FIR and has no seized property in his possession.
  • Whether the petitioner’s criminal antecedent of four cases affects the grant of anticipatory bail.

2 01-07-2026 1. Heard learned counsel for the petitioner and

                   learned APP for the State.

                                2. The petitioner seeks bail in anticipation of his

arrest in a case registered for the offences punishable under

Section 30(a) of the Excise Act.

                                3. The learned counsel for the petitioner submits that

the petitioner has antecedent of four cases out of which one case

under the Excise Act and allegation is of recovery of 82.4 litres

petitioner was not arrested from the spot, as such, nothing was

recovered from his conscious possession and is not the owner of

any of the seized motorcycles and is also not named in the FIR

but then, it is submitted that off late police has started

implicating accused with criminal antecedent in cases relating to

excise for obvious reason without holding a proper

counsel for the petitioner, the petitioner, above-named, in the

event of his arrest or surrender before the learned Court below

within a period of six weeks, is directed to be released on

sum of Rs.20,000/- (Rupees Twenty Thousand) with two

the conditions laid down under Section 438(2) of the Cr.P.C.

                       7. The application stands allowed.

                       8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify

the criminal antecedent of the petitioner and in the event, if it is

found that petitioner has antecedent of more than four cases,
