Patna High Court

Munna SinghversusThe State of Bihar

Decided

DISPOSED

Holding

The court granted provisional anticipatory bail to the petitioner, subject to conditions and verification of his criminal antecedents.

Summary

The petitioner, Munna Singh, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 396 litres of liquor from a motorcycle, which he claims he did not own and was not in possession of at the time of seizure. He contended that a watchman (Chowkidar) with whom he has an inimical relationship falsely implicated him, and questioned why the watchman did not inform police earlier. The petitioner sought anticipatory bail, arguing lack of direct involvement and the unreliability of the prosecution's evidence. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and directed verification of the petitioner’s criminal antecedents, stating that if more than one prior case is found, the bail would not be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances.
  • Whether the petitioner’s alleged lack of ownership and possession of the seized vehicle negates the basis for arrest.
  • Whether the watchman's testimony is sufficient to sustain the FIR.
  • Whether the petitioner’s criminal antecedent warrants denial of anticipatory bail.
