Patna High Court

Binod RaiversusThe State of Bihar

DISPOSED

Holding

The court granted provisional anticipatory bail subject to conditions and verification of criminal antecedent.

Summary

The petitioners, Binod Rai, Manjay Rai and Akhilesh Rai, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 103.68 litres of liquor from a Bolero vehicle. They contended they have clean antecedents, were not arrested at the spot, did not have the liquor in their conscious possession, and were implicated by a watchman with whom they have a hostile relationship. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs. 500 with two sureties and directed verification of the petitioners' criminal antecedents. If any antecedent is found, the bail would not be confirmed for that petitioner; otherwise, the provisional bail would be confirmed. The order was made under Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioners' alleged lack of conscious possession and clean antecedent justify anticipatory bail.

2 01-07-2026 1. Heard learned counsel for the petitioners and

                   learned A.P.P. for the State.

                             2. The petitioners apprehend their arrest in a case

                             4. Learned counsel for the petitioners submits that the

of the seized vehicle and they came to be implicated at the

instance of Chowkidar with whom they are on an inimical term.

It is next submitted that if Chowkidar was aware about the

involvement of the petitioners in the occurrence, then why he

did not inform the police prior to institution of the instant FIR,

which casts an aspersion on the case of the prosecution.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioners.

                   6. Considering the submissions made by the learned

counsel for the petitioners, the petitioners above-named, in the
