Kishan KumarversusThe State of Bihar

The Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s antecedent.

Summary

The petitioner, Kishan Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act, where 54 litres of liquor were allegedly recovered from his house and 14 litres from an open place. He argued that the liquor was not in his conscious possession, the house is joint family property, and the 2018 amendment to the Excise Act abolished the concepts of deemed possession and presumed offender. The State opposed the bail. The Court, considering these submissions, granted provisional anticipatory bail on the condition that the petitioner surrender within six weeks, furnish bail bonds of Rs.5,000 with two sureties, and comply with Section 482(2) of the CrPC. The order also directed the trial court to verify the petitioner’s criminal antecedent, stating that if more than one prior case is found, the bail may not be confirmed, whereas a single antecedent would lead to immediate confirmation. The provisional bail is thus subject to verification by the trial court.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where alleged possession is disputed.
  • Whether the 2018 amendment to the Bihar Excise Act eliminating deemed possession affects the bail application.
