Holding

The court granted provisional anticipatory bail with conditions, pending verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Deepak Kumar, was implicated in a case under Section 30(a) of the Bihar Excise Act for allegedly recovering 102.4 litres of liquor from a motorcycle. He contended that he was not caught in possession, was not the owner of the vehicle, and was framed by a watchman with whom he had a personal dispute. The petitioner has five prior criminal cases, four of which relate to the Excise Act. The State opposed his prayer for anticipatory bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.20,000 with two sureties and directed the trial court to verify his criminal antecedent; if more than five prior cases are found, the bail would not be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the excise case and his prior criminal antecedent.
