Patna High Court

Nawal Kishor SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, directing his release on bond with conditions.

Summary

The petitioner, Nawal Kishor Singh, was charged under Sections 316(3) and 318(4) of the Bhartiya Nyaya Sanhita, 2023 and Section 7 of the Essential Commodities Act for alleged black‑marketing of wheat and rice as a PDS dealer. He had been in custody from September 2022 to February 2025 and was released after acquittal in a separate POCSO case. He contended that his shop’s records and e‑POS machine had been tagged to another dealer, leading to alleged stock shortages, and argued that wheat and rice were not listed as essential commodities under a 1986 Bihar notification. The State opposed his bail application. The court, after considering the factual submissions, directed that the petitioner be released on bail with a bond of Rs.10,000 and two sureties, subject to conditions under Section 438(2) CrPC and Section 482(2) BNSS.

Issues considered

  • Whether bail should be granted to the petitioner charged under the Bhartiya Nyaya Sanhita and Essential Commodities Act.
  • Whether the alleged tagging of the shop’s records to another dealer affects the bail consideration.
