Holding

The Court granted provisional anticipatory bail to the petitioner subject to specified conditions.

Summary

Kishun Sahni applied for anticipatory bail fearing arrest in a case under Sections 30(a) and 37 of the Bihar Prohibition and Excise Act, alleging that the only evidence against him is a confessional statement made by another accused in police custody and that he was not caught in possession of liquor. The petitioner argued that such a statement lacks evidentiary value and that the police mechanically implicate persons without proper investigation. The State opposed the bail. The Court, considering the submissions, granted provisional anticipatory bail subject to a bail bond of Rs.5,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS. The order also directed verification of the petitioner’s criminal antecedent, with the bail to be confirmed only if he has a single prior case, and required a deposit of Rs.2,500 with the Patna High Court Advocate Association.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances alleged.
  • Whether the confessional statement of another accused can form a basis for arrest.

recovered from his conscious possession. It is further submitted

that petitioner came to be implicated based on the confessional

not have any evidentiary value in the eye of law. It is next
